On 10 September Naktuinbouw organized a webinar with 70 participants in the room and 17 through a web connection. In the discussion on a number of presentations conclusions could be drawn concerning the ownership of the DUS sample and the use of DNA of the DUS samples.

The applicant is owner of the DUS sample and the DNA of that sample throughout and after the procedure. The DUS sample and DNA may only be used for DUS test purposes, inclusion in a reference collection and exchange with other EU entrusted offices or certification authorities. When material is exchanged, the applicant/breeder should be informed. For other actions the consent of the applicant/breeder is needed. Exception to this rule is the use of DNA of DUS samples in anonymized (coded) form. The use of fast DNA techniques in infringement cases is extremely important.

Three speakers shared there knowledge:

• Kees van Ettekoven, head Variety Testing Department Naktuinbouw gave two presentations on: Ownership and use of DUS samples during and after the DUS tests, and, The use of DNA and DNA data during and after the DUS tests.
• Hedwich Teunissen; R&D laboratory Naktuinbouw and responsible for DNA testing, spoke about: The use of DNA techniques in the DUS procedure and in case of suspicion on infringement.
• Casper van Kempen, Managing Director AIB (Anti-Infringment Bureau for IP Rights on Plant Material), gave a presentation on the importance of DNA techniques and availability of reference material in the fight against infringement on Plant Breeders’ Rights.
