Syngenta, a leading global agriculture company, and Rijk Zwaan, an international vegetable breeding company, today announce they have signed an extensive cross-licensing agreement on native traits in vegetables.
Under the agreement, the parties provide each other the right to use biological material that falls under the scope of their patents for both breeding and commercial purposes in vegetables. The agreement thus increases the possibilities for both companies to develop new and improved vegetable varieties by making use of each other’s innovations. The agreement establishes a full breeders’ exemption between the parties for such patents as exists under the worldwide plant breeders’ right system.
The signing of this agreement is the direct result of dialogues that led to the foundation of the International Licensing Platform Vegetable (ILP), of which both companies were founding members. The ILP makes vegetable related innovations widely available to breeders by an open access approach that offers members access to patents on native traits under fair and reasonable conditions. The ILP currently has 12 members and is open for new seed companies and public research institutes to join.*

Syngenta en Rijk Zwaan maken uitgebreide licentieovereenkomst bekend voor eigenschappen in groenten

Syngenta, een toonaangevende, mondiaal opererende agro-onderneming, en het internationale groenteveredelingsbedrijf Rijk Zwaan maken vandaag bekend een uitgebreide kruislicentie-overeenkomst te hebben getekend voor natuurlijke eigenschappen in groenten.
Middels deze overeenkomst verschaffen de partijen elkaar het recht om biologisch materiaal dat onder de reikwijdte van hun octrooien valt, te gebruiken voor veredeling en commerciële doeleinden in groenten. De overeenkomst vergroot hiermee de mogelijkheden voor beide bedrijven om nieuwe en verbeterde groenterassen te ontwikkelen door gebruik te maken van elkaars innovaties. De overeenkomst voorziet tussen de partijen in een volledige veredelingsvrijstelling voor octrooien, zoals die in het internationale kwekersrecht bestaat.
De ondertekening van deze overeenkomst is het directe gevolg van de gesprekken die leidden tot de oprichting van het International Licensing Platform Vegetable (ILP), waarvan beide bedrijven tot de oprichters behoorden. Het ILP maakt innovaties in groenten breed beschikbaar voor veredelaars middels een “open access”-benadering die leden tegen eerlijke en redelijke voorwaarden toegang biedt tot octrooien op natuurlijke eigenschappen in groenten. Het ILP heeft op dit moment 12 leden en staat open voor deelname van nieuwe zaadbedrijven en publieke onderzoeksinstellingen.*

Rijk Zwaan signe un contrat de licence d’exploitation des caractères végétaux avec Syngenta
Syngenta, un intervenant majeur de l’agrofourniture, et Rijk Zwaan, une entreprise internationale de recherche et de sélection en semences potagères, ont annoncé le 9 septembre dernier, avoir signé un contrat de licence et d’exploitation réciproque des caractères génétiques des végétaux.
Cet accord :
- Permet à ces 2 entreprises de recherche et de sélection d’optimiser leurs capacités d’innovation
- Permet d’envisager un bénéfice multipartite, non seulement pour les agriculteurs mais aussi pour les consommateurs, grâce à l’introduction plus rapide de variétés génétiquement plus performantes.
A travers ce contrat de licence, les 2 parties se donnent mutuellement le droit d’utiliser du matériel biologique végétal régi et protégé par des brevets, aussi bien pour une exploitation commerciale qu’à des fins de recherche et de sélection.
Cet accord permet ainsi d’augmenter les possibilités pour les 2 entreprises de développer du matériel génétique plus performant grâce à une utilisation conjointe de leurs innovations. Cet accord constitue une véritable dérogation pour la recherche entre les 2 entreprises au regard des systèmes de brevets et de droits d’obtenteurs qui régissent habituellement tout processus d’innovation.
La signature de cet accord est le résultat direct de plusieurs échanges qui avaient abouti à la création de l’ILP (International Licensing Platform Vegetable) dont les 2 entreprises sont membres fondateurs. L’ILP permet aux sélectionneurs d’avoir accès à des innovations végétales à travers une approche « libre d’accès » qui autorise ses membres à avoir accès à des caractères génétiques protégés par des brevets, selon des conditions équitables et raisonnables. Actuellement, l’ILP compte 12 membres, mais reste ouverte évidemment à l’entrée de nouveaux acteurs, aussi bien des entreprises de sélection et de production de semences que des instituts publics.
David Morgan, directeur de la section semences potagères chez Syngenta ajoute : « C’est la sécurité d’avoir un accès permanent à de nouveaux caractères, permettant ainsi de créer de nouvelles variétés avec de véritables bénéfices non seulement pour les agriculteurs mais aussi pour les consommateurs. Cet accord de licence avec Rijk Zwaan nous permet d’accélérer la recherche variétale et de proposer ainsi plus rapidement de nouveaux produits sur le marché. Syngenta pense que les caractères génétiques tout comme les nouvelles technologies devraient être accessibles à l’ensemble des sélectionneurs à travers le monde. C’est pourquoi nous avons lancé notre propre plateforme de licence d’exploitation en ligne. Cela permet ainsi aux sélectionneurs et aux instituts de recherche variétale à travers le monde d’avoir accès à l’ensemble des caractères génétiques protégés par des brevets et présents au sein de nos variétés commerciales pour développer des variétés qui sauront satisfaire les agriculteurs et les consommateurs ».
